These Terms of Service (“Terms”) govern the use of Contact Photo’s website, services, and in-person or mail-in film processing, scanning, printing, and related offerings (“Services”). By accessing our website, submitting film or digital files, or placing an order, you agree to these Terms.
1. Acceptance of Terms
By using Contact Photo’s Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Returns, Refunds & Limits of Liability Policy and any other policies referenced herein.
If you do not agree, you should not use our Services.
2. Services Provided
Contact Photo provides professional photographic services, which may include:
- Film developing (C-41, black & white, E-6, and other processes)
- Film scanning
- Digital file delivery
- Fine art inkjet printing
- Large format and specialty scanning/printing
- Educational workshops and related programming
We reserve the right to modify, suspend, or discontinue any Service at any time without prior notice.
3. Orders & Payment
- All orders must be fully paid before processing begins unless otherwise agreed in writing.
- Prices are subject to change without notice.
- Additional charges may apply for push/pull processing, special handling, or custom requests.
- Applicable taxes and shipping fees will be added at checkout or invoiced accordingly.
We reserve the right to refuse or cancel any order at our discretion.
4. Turnaround Times
All turnaround times are estimates only and are not guaranteed.
Delays may occur due to equipment maintenance, chemical replenishment, staffing, supply issues, shipping delays, weather events, or other unforeseen circumstances.
Contact Photo is not liable for missed deadlines or resulting losses.
5. Customer Responsibilities
By submitting materials, you agree that:
- You own or have legal rights to all film, images, and files submitted.
- All materials are legal and do not infringe on any third-party rights.
- Film is properly packaged for shipping (if applicable).
- All instructions provided are accurate and complete.
- Digital files submitted for printing are final and ready for production.
Contact Photo is not responsible for issues arising from improper exposure, camera malfunction, film defects, or pre-existing damage to materials.
6. Copyright & Usage Rights
Customers retain full ownership and copyright of all submitted images and materials.
By submitting materials to Contact Photo, you grant us a limited, non-exclusive license solely for the purpose of:
- Processing film
- Scanning negatives
- Printing images
- Storing files temporarily
- Delivering completed orders
We will not use customer images for marketing, promotional, or commercial purposes without explicit written permission from the customer.
7. Mail-In Orders & Shipping
Customers are responsible for properly packaging and shipping all materials to Contact Photo.
Contact Photo is not responsible for:
- Lost, delayed, stolen, or damaged shipments
- Carrier handling issues
- Customs delays (if applicable)
Risk of loss transfers to the carrier once shipments leave our facility or are accepted by a shipping provider.
Customers may choose to add insurance for return shipments when available.
8. Storage of Materials
Unless otherwise specified:
- Physical negatives and original materials are stored for 30 days after order completion.
- Digital files are stored for 60 days after delivery.
After these periods, materials and files may be permanently deleted or disposed of without notice. Contact Photo is not responsible for recovery of expired materials.
9. Acceptable Materials
We reserve the right to refuse or discontinue processing of any materials that are:
- Moldy, leaking, or chemically unstable
- Wet or improperly dried
- Damaged in a way that could harm equipment or other orders
- Suspected to be hazardous or unsafe
- In violation of applicable laws or third-party rights
Fees for inspection or return shipping may still apply.
10. Intellectual Property (Contact Photo)
All website content, including but not limited to logos, branding, text, design, and images created by Contact Photo (excluding customer-submitted work), are the property of Contact Photo and may not be copied, reproduced, or distributed without permission.
11. Privacy
Your personal information is used solely for order processing, customer service, and operational purposes.
We do not sell customer data. For more information, please refer to our Privacy Policy (if applicable).
12. Limitation of Liability
To the maximum extent permitted by law, Contact Photo shall not be liable for:
- Lost, damaged, or undeveloped images
- Loss of income, business, or opportunity
- Emotional or artistic value of materials
- Delays in processing or delivery
- Errors arising from customer-provided information or materials
- Indirect, incidental, or consequential damages
Our total liability for any claim shall not exceed the amount paid for the specific service, plus replacement value of unexposed film where applicable, as outlined in our Returns, Refunds & Limits of Liability Policy.
13. No Guarantee of Results
Photographic results vary based on exposure, film type, camera settings, and environmental conditions.
Contact Photo does not guarantee specific aesthetic outcomes, color reproduction, density, contrast, or artistic interpretation unless explicitly agreed in writing for specialized services.
14. Force Majeure
Contact Photo is not liable for delays or failure to perform due to events beyond reasonable control, including but not limited to:
- Natural disasters
- Fire, flood, or water damage
- Power outages
- Equipment failure
- Labor shortages or disputes
- Supply chain disruptions
- Carrier delays
- Government actions or restrictions
15. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Kings County, New York, and you consent to jurisdiction in those courts.
16. Changes to Terms
Contact Photo reserves the right to update or modify these Terms at any time without prior notice. Continued use of our Services constitutes acceptance of any updated Terms.
17. Entire Agreement
These Terms, along with our Returns, Refunds & Limits of Liability Policy and any other posted policies, constitute the entire agreement between you and Contact Photo regarding use of our Services.
